These Terms of Service apply to your use of www.outcaest.com and to any orders you place through the website. OUTCÆST® is operated by Jazz Dharma, trading as OUTCÆST® ("we", "us" or "our"). Please read these Terms of Service carefully before using the website or placing an order.
Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We may update, change or replace parts of these Terms of Service by posting an updated version on our website. Changes will apply from the date they are published and will not affect any order we have already accepted, unless a change is required by law or agreed with you.
Our store is hosted on Big Cartel, LLC. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.
2. Online Store Terms
By placing an order, you confirm that you are at least 18 years old and that you are legally able to enter into a contract. These Terms are intended for customers purchasing as consumers. Please contact us before placing an order for resale or other business purposes. You may not use our products, website or Services for any illegal or unauthorised purpose, or use the website in a way that violates applicable law or the rights of another person. We may decline an order or restrict access to the Service for a legitimate reason, including suspected fraud, failed payment, stock unavailability, delivery restrictions, unlawful use or a material breach of these Terms. Where we cancel an order after payment has been taken, we will notify you and refund the amount paid. Payments are processed by third-party payment providers, and we do not store your full payment-card details. You agree not to reproduce, duplicate, copy, sell, resell or commercially exploit any part of the Service or website content without our prior written permission, except where permitted by law.
4. Accuracy, Completeness and Timeliness of Information
We take reasonable care to ensure that information on this website is accurate, complete and current. Product descriptions, prices and availability shown when we accept your order form part of our contract with you. General editorial, blog or historical information may become out of date and is provided for reference only. If we discover an error that affects a product or an order, we will deal with it in accordance with section 12 below. Nothing in this section limits your rights where goods are faulty, not as described or otherwise fail to meet applicable consumer-law requirements.
5. Modifications to the Services and Prices
Prices for our products may change without notice before an order is accepted. A price change will not affect an order we have already accepted. We may update, suspend or discontinue all or part of the website or Service where reasonably necessary, but this will not affect your rights in relation to an accepted order. We will not be responsible for an interruption or change that is outside our reasonable control, subject always to section 14 and your statutory rights.
6. Products or Services
Certain products or Services may be available exclusively online through the website. Products may have limited quantities and are subject to our Return Policy, which forms part of these Terms. We make reasonable efforts to display product colours, images, measurements, materials and other details accurately, but colours may appear slightly different depending on your screen and settings. Fit, support and sensory experience vary from person to person, so our descriptions and Sizing Guide should be used as guidance rather than a guarantee that a product will meet every individual preference. This does not affect your statutory rights.
We may limit the quantity of products purchased in a single order or decline sales to particular locations for legitimate stock, delivery, legal or fraud-prevention reasons. We may discontinue a product before accepting an order. Products supplied by us must be as described, of satisfactory quality and fit for any particular purpose that you make known to us before purchase and that we agree the product is suitable for.
7. Accuracy of Billing and Account Information
When you place an order, you are making an offer to buy the products in your basket. An automated order acknowledgement confirms that we have received your order but does not mean that we have accepted it. A contract is formed when we send you a dispatch confirmation, unless we expressly tell you otherwise. We may decline an order before acceptance because a product is unavailable, payment cannot be authorised, we cannot deliver to the address supplied, the order appears fraudulent or intended for unauthorised resale, or there is an obvious pricing or description error.
If we cannot accept your order, we will tell you and refund any payment already taken. You agree to provide current, complete and accurate billing, delivery and contact information so that we can process your order and contact you when necessary. Risk in the products passes to you when they are delivered to you or to a person you have identified to receive them. Your cancellation and return rights are explained in our Return Policy.

12. Errors, Inaccuracies and Omissions
Occasionally, information on our website may contain a typographical error, inaccuracy or omission relating to a product description, price, promotion, delivery charge, delivery estimate or availability. We may correct an error and update the website at any time. If we identify an error before accepting your order, we may decline the order and invite you to place a new order using the corrected information.
If we identify an error after accepting your order, we will contact you promptly and explain the available options. We will not charge you a higher price or make a material change to an accepted order without your agreement. If we cannot fulfil the order on the agreed terms, we may cancel it and provide a full refund. We have no general obligation to update historical or editorial content except where required by law, but product and order information will be handled in accordance with these Terms and your statutory rights.

14. Disclaimer of Warranties; Limitation of Liability
We use reasonable care and skill in operating the website, but we cannot guarantee that it will always be uninterrupted, secure or error-free. Temporary maintenance, technical faults or events outside our reasonable control may affect availability. This website-access wording does not reduce the standards that apply to products you purchase from us.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, faulty or misdescribed goods, breach of your statutory consumer rights, or any other liability that cannot lawfully be excluded or limited. We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable when the contract was formed, loss caused by your own breach or misuse, or business losses where you are purchasing as a consumer. Nothing in these Terms affects any legal right to a refund, repair, replacement or other remedy.

This responsibility applies only to the extent that the loss was caused by you and can lawfully and fairly be recovered. We may suspend or terminate access where you materially breach these Terms, use the website unlawfully or create a genuine security risk. Where reasonably practicable, we will give notice and an opportunity to stop the breach before taking action.
Termination will not affect an order we have already accepted, any rights or obligations that arose before termination, any amount lawfully due, or your statutory consumer rights. Provisions that are intended to continue after termination, including intellectual-property, liability and governing-law provisions, will remain effective.
